Delays in Processing Article 116 II GG Petitions

BY Alexandra Margalith Strul

Who is affected by these delays?

You may have heard that the German Federal Administration Office (BVA) is experiencing unprecedented delays in processing Article 116 II GG citizenship restoration petitions. You may be wondering how this will affect your petition and whether your path to reclaiming your German citizenship is now at risk.

Please note that, while this is true, it affects only petitions filed under the Article 116 II GG route. Petitions filed under Section 5 or Section 15 of the German Nationality Act are not affected by the delay and are progressing as normal.

What happened to cause these delays?

To understand what is happening, it helps to look at the background. Over the last few years, a historic surge of applicants from the UK, North America, and Israel has flooded the BVA, driven by geopolitical shifts and Germany’s recent modernisation of its citizenship laws. The current bottleneck, however, is tied to a specific event: German investigative authorities recently uncovered an international fraud network operating from China, which was fabricating family trees and forging historical lineages to obtain German passports illicitly under the guise of restitution.

In response, the BVA has taken decisive action. To safeguard the integrity of the restitution process, it has introduced a comprehensive security review and a temporary pause on the handover of final certificates. The BVA is now meticulously auditing files and cross-referencing applications with federal security agencies. As a result, every petition is subject to a level of scrutiny never seen before, and standard processing times are lengthening across the board.

Our take on the delays

We understand that these industry-wide delays are disappointing, but our clients should not worry. The BVA’s tightened security measures are explicitly designed to catch fraudulent, incomplete, or poorly constructed applications – problems that simply do not apply to our clients.

At German Citizenship Restoration (GCR), we have always worked on the principle that a petition must be entirely airtight before it leaves our office. We do not rely on guesswork or lose documentation. Our legal expert, Alexandra, rigorously vets every generational link, obtains certified historical records directly from German archives, and pre-verifies the legal basis of your claim. Because the BVA knows our submissions are comprehensive, fully verified, and legally sound, GCR petitions hold up well under this heightened scrutiny. We make sure your application is built to pass the strictest audit, keeping your path to a German passport secure, stable, and completely on track.

We are also hopeful that, with these new measures in place, the BVA will be able to make its processing system more efficient, which should lead to shorter processing times in the near future.
